Registration of All India Samta Sainik Dal (AISSD) & Importance of registration

Following are general observations/opinions on the comments raised by our many people on the registration of the All India Samta Sainik Dal:

  • There is definitely lack of knowledge of this field (registrations of organizations) amongst those people who are against the registration of AISSD
  • They are only emotionally charged up but there is big absence of legal or logical reasoning behind their support for non-registration of AISSD.
  • Their only contention is that “when Bodhisattva Dr. Babasaheb Ambedkar has not registered the AISSD, then why have we registered the same? If RSS works without registration, why AISSD needs registration ? And nothing else.”

I would like to provide my counter contentions to the aforesaid contentions raised by those people:

Right from 2007 till 2014 I was working in an association with a CA firm, through we have registered many Hindu, Muslim, Christian Religious/Social organizations, being a part of our professional practice. If these other religious/social oorganizations duly gets their registrations under the respective acts, as applicable to them, the source of which is an entry in the article from the CONSTITUTION OF INDIA, prepared by none other than Bodhisattva Dr. Babasaheb Ambedkar, then why follower of Babasaheb Ambedkar are against the fact that one should register this organizations under the respective act, as applicable to them, the source of which is an entry in the article from the CONSTITUTION OF INDIA, prepared by Bodhisattva Dr. Babasaheb Ambedkar.

In short, I want to say when the other religious/social manuwadi people or organizations take the shelter of the constitution to legalize or regularize all their non-sense or rubbish activities, then why are follower of Babasaheb Ambedkar hesitant to do the same for their noble or kind activities???

My second counter contention is that, “In which CONSTITUTION it is written that if a particular noble work (registration in our case) is not done by Dr. Babasaheb Ambedkar, then it should not be done by his followers?” In my opinion Dr. Babasaheb Ambedkar said , “तुम्ही जर हा माझा समते चा रथ पुढे नाही घेऊन जाऊ शकत, तर, निदान त्याला महागे तरी घेऊन जाऊ नका.” When we know that Dr. Babasaheb Ambedkar was not a Civil or Software Engineer or Pilot or Chartered Accountant or Chief of Army, Navy or Airforce and so on …

But does it mean that just merely of the fact that Dr. Babasaheb Ambedkar did not pursued these degrees or courses, we should not also pursue these courses ???

My third contention is the answer to the question that why Dr. Babasaheb did not registered and why we should register our organizations. At the time when Dr. Babasaheb Ambedkar was alive, especially every Hindu/manuwadi and even Babasaheb’s follower knew that Dr. Babasaheb Ambedkar is a very good advocate to prove his contentions in the court of law. So nobody could have ever even dared to thought of causing any threat to the organizations created by Dr. Babasaheb Ambedkar, merely on the such contentions like a) it is unregistered or b) it is lacking certain procedural formalities and so on.

But today’s environment is totally different from that one of Dr. Babasaheb Ambedkar’s era. Today is the government of the Hindu extremist. If Dr. Babasaheb Ambedkar’s organizations are unregistered then what is the probability that these Hindu extremist can’t take initiative to shut down such organizations, taking the shelter of the constitution itself that ours are an unconstitutional organizations???

In fact, I myself question the constitutional validity of such unregistered organizations. I ask a question to the readers of this post that do our unregistered organizations even have a right to distribute the constitution of India compiled by Bodhisattva Dr. Babasaheb Ambedkar, when they itself have not registered under the respective acts, as applicable to them, the source of which is an entry from the various articles of the constitution itself???

My fourth contention is that, what is the probability that all the members of the unregistered organization can’t be held responsible as guilty of any offense which is not committed by them???

Ultimately, when the case goes into the shoes of the court of law, the first question irrespective of the offense being charged with is that, “what is the legal status of your organization?” If registered, then it’s ok. But if it is unregistered, then next question is that where the law requires it to be registered, then till now why the owners/members of the organization have not registered it??? And then the penalty, interest, charges, fees, fines etc. for non-registration under the respective act is levied & collected from the defaulters and then the case is taken to the its ultimate domain, where the members of that unregistered organization can be treated at par with that of any other culprit.

My fifth contention is that we should ask the question to the supporters of non-registration of our organizations that,

  1. Do they register their vehicles with the RTO ?
  2. Do they register their names on the 7/12 extract on purchase of land?
  3. Do they register their names with the Income Tax and Sales Tax Department by means of obtaining PAN or TIN respectively?

If answer to above questions is yes, why not the same be followed for organization started by Dr. Babasaheb Ambedkar ???

Many of the organization gets closed/divided due to financial crisis or for not keeping auditing of incoming/outgoing flow. Registration certainly helps here to solve that issue by having proper official bank account by organization name and helps in keeping clean audits of our financial transactions/records.

Those who were involved in doing registration of AISSD, were the workers of then SSD who also worked with Babasaheb; never ever surrender themselves to any political party and kept this SSD mission alive in some form. Considering their commitments and making sure that no one else divide AISSD into any sub-brackets/sub-categories like RPI(A), RPI(B) etc…….AISSD has been registered. Now, no one can use the same name and divide AISSD(A), AISSD(B) etc…….I feel this is the BEST thing which could be proud of in making strong single unified base of AISSD without any brackets/groups.

SCF and BSI were registered and SSD was integral part of SCF during Babasaheb’s time. Then SCF later RPI, when it broken into pieces after Babasaheb, post 1956 era, there was no point in breaking SSD also and hence AISSD has been formed and separately went for registration as its affiliation with any political fraction had been removed, to keeping single unified base of our social reformation/revolution.

Current General Secretary of All India Samta Sainik Dal, Dr. Sanjay Gajbhiye sir, himself said that, if we are inviting trouble to Babasaheb’s followers because of this registration, then the core committee of the AISSD is even ready to surrender the registration of AISSD, for the welfare of our community, which shall be in the best interests of our people.

We should think practically, logically and legally for the betterment of our community.

  1. First of all, it is important to think , that the army force, military, para military, or the functions of the organizations are seems to be military discipline , generally not registered. Let me ask , what is the meaning of Samta sainik Dal ? The meaning of Samta sainik Dal is Equality Army force. The sole purpose of the force is to safeguard the depressed community of the Indian Society, to extend protection, it is necessary to be used protective means by trained soldiers . And there is nothing wrong to protect self, family, community from any type of atrocities . Why Bodhisattva Dr. Babasaheb Ambedkar has not registered the SSD, then why have we registered the same by adding words “”ALL INDIA””.
    Not only SSD or RSS but the force founded by Lenin in Russia, or the force founded by Mao Tse-tung: [Mao Zedong ] in China , were not registered. They are remembered for their Social,cultural , economical revolution in their Nations . No country is there which has registered their military forced registered . Once you have registered the organization, you have to show all the activities to the public , you can not hide, Your are bound to show by the Government. But the military , the force are not bound to show all the activities to the general public, some activities are to be hidden in the interest of the nation/ public .

      The name of Organization is “Samta Sainik Dal”. Why All India is added?

    Your justification are merrily blabla nothing else. We can’t compare ourself with Babashab. Remember “we are becasue he was” you have quoted his saying very well please so follow the same. Nothing is done without a purpose. One should understand it. SSD is force of depressed people where ruling party’s or goons can acts unlawful illegal act legally and once you are under govern you can’t act. Forces have their own strategies and plans for any uncertain situation which has to be no where disclosed.
    Not writing more in details considering you are well educated and read unwritten thing’s as well.
    Secondly Dr. Sanjay Gajbhiye sir is right. Hope you will surrender registration as public demand and its public organization one need to respect our people.

      My 2 cents:

      I m pretty confident that you do not want to do any illegal things in India under SSD banner. If yes please do let me know too. Second, whether organization is under government act of registration or not, fascist government would nab you no matter where you would like to hide in India. Look at the innocent people who got arrested in so many cases including Bhima Koregaon cases (just to name it for an example). Our government employees can’t be part of social organization legally which is not registered. So, I m sure you can see hell lots of problem.

      Lets take it offline we can exchange thoughts and see what is best for us to drive the mission. We have lots of things to do and we can safely ignore this registration as it doesn’t create any harm but helps in lot of better ways to run as per Dr. B. R. Ambedkar’s constitutional acts.
